Aditya**: Can Contract Be Enforced Without Consideration?

contract clat_ug advanced discussion

Ab bhaiyo, humein aaj contract law ke ek bade question par sochna hai - kya contract ko lagu karna sambhav hai bina consideration ki? Main ek bahut hi strong case ke liye tareef karta hoon - the Indian Contract Act 1872 ka Section 25, jo kehata hai ki a contract ke peechhe koi bhi consideration nahi hona chahiye, iske liye ek vachan ki aavashyakata hoti hai. Lekin ab aapke paas ye sawal hai - kya vachan keval ek contractual agreement nahi hai magar yeh bhi jaankari hai ki ye ek vachan hai jo contract ki aavshyakta hoti hai.

Aapke paas kya vichaar hain?

Yeh question bahut interesting hai! In my opinion, yes, a contract can be enforced without consideration. According to S. 25 of Contract Act, 1872, a promise to do something, which is not a past consideration, can create legal obligation. For eg, a promise to marry, which is not supported by consideration, can still be enforced under special marriage laws. Agree or disagree, anyone?
