Accidental Shooting by a Mentally Unsound Friend

cpc clat_ug beginner hypothetical

Okay, so this is what I'm thinking... Imagine you're out partying with your best friend, Rohan, who's been acting weird all night. He gets into a fight with another guy and while chasing him, Rohan's mentally unsound state leads to an accidental shoot - he accidentally shoots you in the leg with his dad's licensed gun! In the heat of the moment, he flees the scene, leaving you bleeding on the floor.

Now, under IPC Section 84, 'act of a person of unsound mind' is a total exemption from criminal liability. Would that plea work in this hypothetical? Would the court accept that Rohan's unsound mind led to the accident? And what if you file a complaint against him under the Arms Act for misusing a licensed gun? What if your parents sue him for compensatory damages under the Consumer Protection Act?
