Abolishing Section 377: Still No Consent
criminal judiciary advanced reform_ideaAbuse of power is a recurring theme in many rape cases. However, Section 375 deals with rape in two scenarios - when the accused is a man, it's clear, but what about when the accused is a woman? It still classifies it as 'rape' only when the woman doesn't consent OR is incapable of giving consent. But what if there's abuse of power, like say, a prison warden or a government official? The consent is basically coerced at gunpoint or under threat of violence. The IPC has no provision to differentiate between rape due to force and that due to power misuse. It's time to add a new clause that makes exploitation by abuse of power a specific crime. Otherwise, how can we truly say 'Justice for all'?

Mujhe lagta hai, Section 377 ka abolition hua hai, lekin samajhdaari ki baat hai. Logon ne apne aapko azad karna chahiye tha, parantu consent nahin mila. Agar aapko apni sevaon se pehle unke aashirvaad lena padta hai toh, woh azadi ki kya awaaz hai? Humko samajhna chahiye ki sabhi logon ka samman karna zaroori hai.
Yeh Article bahut relevant hai! Section 377 ko abolish karne ke baavjood, kuch logon ke liye consent still issue hai. Humari samaj mein abhi bhi gay rights ke liye safar kaayam hai. Humko apne rights ke liye ladne ke liye mazboot banana hoga. Let's continue to raise our voices and fight for equality and consent for all!
"Bhai, I partially agree aur partially disagree. Abolishing Section 377 is a major victory, but kuch aur jaroori hai. Consent ko thoda aur dhyan milna chahiye. LGBTQ+ individual ko unke partner ke consent ke baavajood, zindagi me difficulties ke saath jaana padta hai. Government aur civil society ko unki protection ke liye kuch aur karne ki aavshyakta hai.
