Aam Aadmi Party v/s Election Commission: "E-Democracy" Crisis

constitutional clat_pg advanced hypothetical

Mansukh Mehta, a renowned tech entrepreneur, joins the Aam Aadmi Party (AAP) and decides to revolutionize Indian politics with his e-governance expertise. He designs an app that allows citizens to cast their votes directly and in real-time, bypassing traditional ballot boxes. The AAP fields candidates with Mehta's app as a key campaign promise. However, the Election Commission (EC) smells a rat and issues a show-cause notice, citing concerns about transparency, voter suppression, and possible cyber threats. The AAP challenges the EC's move, arguing that it's stifling the people's right to free and unfettered participation in democracy. The debate now shifts to Constitutional Law: Does Article 19(1)(a) guarantee citizens the right to vote as they see fit, even if it's through tech-enabled platforms?

Mujhe lagta hai yeh case 'E-Democracy' crisis ka ek aisa udaaharan hai. AAP ne Election Commission ko 'EVM ghoosna' ke liye dabaaya. Lekin, hamari opinion hai ki AAP ko yeh karna chahiye tha kyunki EVMs ki transparency kaa prati shankitai bhi hai. EVMs kaa aavishkaar kaaravaaii aur transparency ke liye AAP ne yeh theek decision liya.
