From Corporate to Courtrooms: My Journey of Dissecting the Law

I never thought I'd be studying law after five years in the corporate world. But life had other plans, and here I am, dissecting jurisprudence for the CLAT UG. It's been an eye-opening journey, and I must say, the more I learn, the more I realize how different law is from finance. In finance, we called it risk management; in law, we call it due diligence โ€“ same thing, different drama.

Understanding Jurisprudence: The Building Blocks of Law

Jurisprudence, or legal philosophy, is the foundation of law. It's the study of the nature, sources, and principles of law. Think of it as the 'why' behind the law. In India, the Indian Contract Act, 1872, and the Indian Evidence Act, 1872, are two foundational statutes that govern the country's legal landscape. These acts provide a framework for understanding how the law functions and how it applies to real-life situations.

From Principles to Practice: The Art of Due Diligence

Due diligence is an essential aspect of jurisprudence, and it's what sets law apart from other fields. It's the process of researching and investigating the facts of a case to ensure that justice is served. In the landmark case of Ratilal Panachand Gandhi v. Rashmikant Durgaram Gandhi (1967), the Supreme Court of India emphasized the importance of due diligence in contract disputes. The court held that "a contract is a contract of free consent," and that parties must exercise due diligence in fulfilling their contractual obligations.
"Ignorantia juris non excusat" โ€“ ignorance of the law is no excuse.
This maxim highlights the importance of understanding the law and exercising due diligence in all our dealings. It's a principle that applies not just to contract law but to all areas of jurisprudence.

The Relevance of Jurisprudence in Modern India

As India continues to grow and evolve, the need for a strong understanding of jurisprudence becomes increasingly important. The country's legal landscape is rapidly changing, with new laws and regulations being introduced regularly. From the Goods and Services Tax (GST) to the Insolvency and Bankruptcy Code (IBC), the law is becoming more complex. In this environment, the ability to think critically and exercise due diligence is essential. So, why does this matter today? It matters because the law affects us all, directly or indirectly. As citizens, we need to understand the law to make informed decisions and to hold our elected representatives accountable. As law students, we need to grasp the principles of jurisprudence to become effective advocates and leaders in the legal profession. And as individuals, we need to exercise due diligence in all our dealings to ensure that justice is served.

Risk Management of due diligence is v crucial. I mean, yeh sab kuchh bhi ho sakta hai, right? In India, we have Section 23 of the Companies Act, 2013 which says that a non-compliance of due diligence by a director can lead to his personal liability. So, it's all about managing those risks and being prepared for the consequences. Also, legal framework of India is constantly evolving, keeping up with it is a challenge for everyone.
