A Primer for Aspiring Judicial Service Officers

As law students, we're often asked about our aspirations โ€“ and for many of us, a career in the judiciary is a dream come true. But before we can don the robe, we need to understand the intricacies of administrative law, a subject that can make even the most seasoned lawyer squirm. I should know โ€“ I used to panic every time someone said 'mens rea', and it took me a while (okay, a lot of while) to get my head around it. Administrative law, in essence, deals with the relationship between the government and its citizens. It's a vast and complex field, with rules and regulations governing everything from tax collection to environmental protection. But what's key to understanding administrative law is recognizing that it's not just about abstract concepts โ€“ it's about real people, with real lives, being impacted by the decisions of bureaucrats. So, what are the key aspects of administrative law that Judicial Service aspirants need to know? Landmark cases like Maneka Gandhi v. Union of India (1978) and Union Carbide v. Union of India (1991) have shaped the way we approach administrative law in India. In Maneka Gandhi, the Supreme Court held that the government's power to cancel a passport is subject to the principles of natural justice. In Union Carbide, the Court ruled that the government's handling of the Bhopal gas tragedy was a classic example of administrative malfeasance. As Judicial Service aspirants, it's essential to grasp these concepts and more. Administrative law is not just a theoretical subject โ€“ it's a reflection of the power dynamics between citizens and the government. By understanding the intricacies of this subject, we can better appreciate the complexities of our justice system and make informed decisions as judges. In today's India, where governance is increasingly complex and contentious, administrative law matters more than ever. With issues like Aadhaar, demonetization, and the Goods and Services Tax (GST) dominating the headlines, the role of the judiciary in checking government excesses has never been more critical. As aspiring Judicial Service officers, it's our responsibility to stay informed and engaged with the latest developments in this field โ€“ for the sake of our citizens, and for the sake of justice itself.
