Understanding the intricacies of Section 110 of the Transfer of Property Act (TPA) is crucial for any law student aiming to ace the Delhi University LLB Entrance. The TPA, a stalwart of Indian property law, governs the nuances of lease agreements and the rights that come with them.

The Anatomy of Section 110

Section 110 of the TPA deals with the premature termination of a lease. It states that a lessee can terminate a lease agreement if the lessor has failed to perform any of the covenants or conditions mentioned in the lease, but only if the lessee has given the lessor a notice of 15 days to rectify the issue. If the lessor still fails to comply, the lessee is free to terminate the lease.

Landmark Case: National Housing Bank v. Canara Bank

In the landmark case of National Housing Bank v. Canara Bank (2009), the Supreme Court of India ruled that a lessee can terminate a lease if the lessor has failed to pay the premium due under the lease agreement. However, the court also held that the lessee must give the lessor 15 days' notice before terminating the lease, as per Section 110 of the TPA.

Key Points to Remember:

The nuances of Section 110 of the TPA are critical for any law student aiming to excel in the realm of property law. The Indian government's recent push for affordable housing and the increasing adoption of digital payment methods have made lease agreements more complex and litigious. In this context, understanding the intricacies of Section 110 of the TPA becomes even more crucial. As the Indian real estate market continues to evolve, the importance of lease agreements and the rights that come with them will only grow. A thorough grasp of Section 110 of the TPA will not only help law students ace the DU LLB Entrance but also equip them with the knowledge needed to navigate the complexities of property law in the real world.

"Bhai, Section 110 of the Transfer of Property Act aaisa to ban jaata hai jo rent-free premises par tenant ko rent ki payment ke liye court mein jao deta hai. Iska pehla condition hai ki tenant ko kuchh samay ke liye rent-free permission mil jata hai. Lekin jab inka koi vishay nahi hai, to tenant ko kabhi bhi notice dete hue rent ki payment karne se inka majrokari nahin ho sakti hai.
