Navigating the Complexities of Taxation in India

Taxation law in India is a vast and intricate topic that requires a deep understanding of various statutes, judgments, and principles. As a law student or junior advocate, it can be overwhelming to navigate through the complexities of tax laws. In this quick reference guide, we will try to simplify the key concepts and provide an overview of Indian taxation law.

The Taxation System in India

India has a dual taxation system, with central and state governments imposing taxes on income. The central government imposes direct taxes through the Income-tax Act, 1961, while state governments impose sales taxes through the Value Added Tax (VAT) Act. The Goods and Services Tax (GST) Act, 2017, has further simplified the tax structure by introducing a unified tax regime.

But, it also imposes on the State a corresponding duty to exercise this freedom with due regard to the general principles of taxation." - Justice P.B. Gajendragadkar, CIT v. Kelvinator of India Ltd. Aur ismein Section 194C ka application nahin hoga. Iska matlab yeh hai ki aapka kuch adhik jatna zaroori hai.
