Offer and Acceptance: The Chicken and the Egg Problem

Imagine you're at a restaurant, and you order a burger. You tell the waiter, "I'll have a burger, please." This is an offer. The waiter then says, "Okay, that'll be Rs 100." This is the acceptance. But what if you didn't order the burger, but the waiter assumed you did? That's where the concept of offer and acceptance gets tricky. In the landmark case of Harman v. Wedge (1851), the court held that an offer must be clear and unambiguous. If there's any doubt, it's not considered an offer. This principle is still applied in Indian contract law.

Consideration: The Price of a Promise

Consideration is the quid pro quo – what you get in exchange for your promise. It can be in the form of money, goods, or services. But what if you promise to do something, but don't get anything in return? That's where the doctrine of promissory estoppel comes in. In the case of Central Inland Water Transport Corporation Ltd. v. Brojo Nath Ganguly (1986), the Supreme Court held that a promise can be enforced even if it's not supported by consideration. This doctrine is often referred to as the " estoppel by promise" rule.

Privity of Contract: The Exclusive Club

Privity of contract is the concept that only the parties to a contract can sue or be sued on it. But what if there's a third party who's affected by the contract? Can they still claim rights? In the case of Tweddle v. Atkinson (1861), the court held that a third party can claim rights under a contract if they're specifically mentioned in the contract.
