Is Jurisprudence just a Joke? (Or is it that I'm just a Law Student?)

As I was studying for my Jurisprudence paper, I couldn't help but think, "Is this really necessary for being a lawyer?" But then I remembered, "Beta, jurisprudence is the foundation of law, na?" My MBA roommate literally cannot understand why I study this. "Why not just learn the rules and regulations?" he'd say. But, that's a different story for another time. Jurisprudence is the study of the nature and sources of law. It's like looking at the DNA of law – you have to understand how it works, what makes it tick, and where it comes from. In India, our jurisprudence is rooted in the Constitution, the Indian Penal Code (IPC), and the Code of Civil Procedure (CPC). The IPC, written in 1860, still governs much of our criminal law, and it's crazy to think about how it's still relevant today. One of the key concepts in jurisprudence is the idea of legal positivism. This theory, propounded by John Austin, says that law is made by human beings and is therefore subject to human will. In India, we have a mix of both positivism and natural law approaches. Our Constitution is based on the principles of natural law, while our IPC is a classic example of positivism in action. When it comes to understanding jurisprudence for AILET, it's essential to know the key concepts and theories. You have to be familiar with the works of famous jurists like Jeremy Bentham and John Locke, and understand how their ideas have shaped our legal system. The Indian judiciary has also played a significant role in shaping our jurisprudence, with landmark cases like Maneka Gandhi v. Union of India (1978) and Puttaswamy v. Union of India (2017). In the words of the Hon'ble Justice R.M. Sahai in Maneka Gandhi v. Union of India, "The principles of natural justice are an integral part of the constitutional scheme and are designed to ensure that the executive action is in conformity with the principles of justice, fairness and reasonableness." So, is jurisprudence just a joke? Not quite. It's the foundation of law, and understanding it is essential for any law student or future lawyer.
