The IT Act, 2000, was a landmark legislation that aimed to regulate electronic commerce, digital signatures, and cybercrime in India. However, over the years, the Act has been criticized for its inability to keep pace with the rapid evolution of technology. This is where cyber law comes in โ€“ a broader term that encompasses not only the IT Act but also other laws, regulations, and international agreements that govern the digital landscape.

The IT Act, specifically Section 43A, deals with the liability of intermediaries (online platforms, social media companies, etc.) for user-generated content. However, in the landmark case of Shreya Singhal vs Union of India (2015), the Supreme Court struck down Section 66A of the Act, which dealt with online offenses, citing concerns about censorship and freedom of speech.

The IPC, in particular, has been amended to include provisions related to cybercrimes, such as hacking (Section 66), cyberstalking (Section 354D), and online harassment (Section 354C).

So, what's the takeaway from this comparison? Cyber law is a broader, more dynamic framework that incorporates various laws and regulations to address the complexities of the digital world. The IT Act, while still relevant, is just one piece of the puzzle. As law students, it's essential to understand these nuances to navigate the ever-changing landscape of cyber law in India.

The company claims it's not liable, citing the IT Act's Section 79, which provides immunity to intermediaries.
