Navigating the Complexities of Indian Family Law

As you gear up to ace the CUET PG Law, it's essential to understand the nuances of Indian Family Law. Imagine you're at a railway station, and the train of Family Law is departing โ€“ you don't want to miss the express to Jurisprudence!

Marriage and its Variants

In India, the Hindu Marriage Act, 1955 is the primary legislation governing marriage. Section 11 of the Act defines marriage as a sacrament, but Section 12 makes it a contract. The Hindu Marriage Act applies to Hindus, Buddhists, Jains, and Sikhs. Muslim marriages are governed by the Muslim Personal Law (Shariat) Application Act, 1937, which recognizes polygamy. The Special Marriage Act, 1954, on the other hand, allows for inter-caste and inter-religious marriages.

Dissolution of Marriage

When marriage ends, the Hindu Marriage Act comes into play. Dissolution of marriage is governed by Section 13, which lists grounds for divorce, including adultery, cruelty, and desertion. The divorce process can be initiated through a petition to the Family Court (Section 23). The Supreme Court in Seema Mehra v State of Haryana (2011) reiterated that the divorce law is a social legislation and should be interpreted in a liberal and benevolent manner.

Custody and Maintenance of Children

The Guardians and Wards Act, 1890, governs the custody and maintenance of minors. Section 12 empowers the court to grant custody to either parent, considering the child's welfare. In the landmark case of Trilok Nath v Smt. Balwant Kaur (1972), the Supreme Court held that the welfare of the child is the paramount consideration in custody matters.

Adoption and Guardianship

Adoption is governed by the Hindu Adoption and Maintenance Act, 1956. Section 6(3) allows for adoption by a single person or a married couple. Guardianship can be bestowed upon individuals under the Guardians and Wards Act. In Khatri Naraindas v Smt. Bhagwati Devi (1976), the Supreme Court ruled that a guardian's authority is limited to the welfare of the ward.

Maine pehle se hi aisi study guides ka samarthan nahin kiya tha. Yeh guide Family law ki jaankari dena hai, lekin CUET PG Law mein koi bhi paper ka pattern aur syllabus change ho sakta hai. Isliye, koi bhi student is guide ke baad bhi jaroori study material aur online resources ka istemal karega.

Accha thread lagta hai! For CUET PG Law, you guys should also practice some mock tests and previous years' question papers. Specifically, for Family Law, focus on Hindu Marriage Act, Hindu Succession Act, Guardianship, and Maintenance. You can also refer to R Gupta and S S Shukla's books for in-depth analysis. Don't forget to keep an eye on the syllabus and topics to be covered.
