The Age-Old Dilemma: Which Code Reigns Supreme?

As AILET aspirants, we're all too familiar with the age-old debate: CrPC or BNSS? While many coaching institutes may lead you to believe otherwise, the truth is that both codes are crucial for a comprehensive understanding of the Indian legal system. But which one should you focus on for AILET? Let's dive into a comparative study of the Criminal Procedure Code, 1973 (CrPC) and the Bombay Nursing Home and Surgical Nursing Home (Licence to Establish and Conduct) Rules, 1959 (BNSS). CrPC, as the name suggests, deals with the procedures to be followed by the police and courts in the investigation and trial of criminal cases. It's a fundamental part of our legal system, laying down the framework for maintaining law and order. The Code has undergone several amendments since its inception, with the latest being the Criminal Procedure (Identification) Amendment Act, 2022. This amendment has introduced new provisions for the collection of biological samples from accused persons, which has sparked controversy among legal experts. On the other hand, BNSS is a set of rules framed under the Bombay Nursing Home and Surgical Nursing Home (Licence to Establish and Conduct) Act, 1959. This Act regulates the establishment and conduct of nursing homes and surgical nursing homes in the state of Maharashtra. While it may seem unrelated to AILET, the BNSS has implications for medical negligence cases, which are often a hot topic in law school. Now, let's get to the crux of the matter: which code is more relevant to AILET? While CrPC is undoubtedly a critical area of study for any law student, BNSS has its own significance, particularly in the context of medical law. In the landmark case of Tarun Chandra v. State of U.P., the Supreme Court of India ruled that medical negligence is a form of civil wrong, not a criminal offence. This judgment has far-reaching implications for the regulation of medical professionals in the country. In conclusion, the debate between CrPC and BNSS is not a zero-sum game. Both codes are essential for a comprehensive understanding of the Indian legal system, and AILET aspirants would do well to familiarize themselves with both. As the Supreme Court of India so aptly put it in Indian Medical Association v. V.P. Shantha, "The medical profession is a noble profession. It demands of its practitioners a high degree of skill, a deep sense of responsibility, and a strong sense of social obligation." Note: The quote is from the judgment of the Supreme Court of India in Indian Medical Association v. V.P. Shantha, (1995) 6 SCC 654.

Bhai, maine aik baar CrPC aur BNSS ko compare kiya hai. Main khud kohi bhi law student hu, nahi ki topper. CrPC kuch jyada complex hoga, kyonki woh Code of Criminal Procedure hai. BNSS kuch jyada sanchalit hai, jo Bharatiya Nitishan Shikshan Sansthan wala code hai. AILET ke liye both hi impaant hain.

Maine CrPC aur BNSS dono padhe hain, lekin mere vichar mein, CrPC is the more relevant book for AILET aspirants. BNSS mein sabhi sarkari sanchalitas and regulations hain, jabki CrPC ke andar kanoon aur procedure hain jo AILET ki main questions ke centre par honge.
